"Orphaned Works" Legislation

Fri Apr 11, 2008, 9:33 PM
I am just in a state of utter outrage after reading this article about the so-called "orphaned works" bill that is going through government right now. I imagine there have been posts about this here on DA before, so sorry if I'm being repetitive, but apparently there will be action taken on the bill in government very soon, so it is vital that all artists stand up and take action to bring this bill down. I hadn't realized just how bad this will be if it should get passed - it amounts to legalized theft of anything and everything we create or have created - even if you've paid the money to register your work with the copyright office in the past. Even if you don't live/work in the US it can affect you because it will break International copyright law, so please be ready to fight to protect your rights as a creator. Please listen to this interview with famous illustrator Brad Holland:

Here's the article as well:

As if it weren't already hard enough to make a living as an artist - leave it to big business and the US government to make it all but impossible.
You can get on the mailing list to receive the latest developments on this issue if you send an e-mail to illustratorspartnership@cnymail.com and ask to get on the Orphan Works e-mail list.

We will all need to write to our representatives to be heard. You can find how to reach them here: [link]
Even if you live in a different country, your voice will make a difference. Every artist, art student, art appreciator needs to get on the band-wagon and put a stop to this nonsense.

If there was ever a time for artists to unite, it's now.

Yep, I saw this on someone else's journal just a little while ago too; I've never written any such letters to congressmen before, but let me tell you, there's a first time for everything! This is the most irritating thing I've ever heard of!
Orphaned! Bah! Simply because you didn't pay 5 bucks to "protect" it? What a load!
I agree wholeheartly.

Government does not have the right to rewrite copyright laws. I'm a little tired of the news that keeps pouring out, but since I'm a very dedicated artist, this greatly concerns me. No artist will stand for this! I certainly won't. I'm positive that if enough people get their voices out, this bill will not pass.

It is just stunning what Congress tries to sneak by simply by slapping an innocuous name on it. Most if those who vote on these don't even read through them. That's how the PATRIOT Act got through.
It's things like this that make me glad I don't live in the US. :#1:

Don't feel glad. Even if you don't live in the US, if you have your works online, and someone from US sees it, they can still use it legally because it's "Orphaned".

Anyone living outside the US should spread word and urge those who does take action on it. Who knows, maybe other countries might opt the same.

That's absolutely outrageous!! I doesn't surprise me that the UK are planning something similar either. I looked into registering copyright here in the UK a few years ago and while books seem quite staight-forward, if you're an artist or an article writer producing a lot of 'small' individual works it would cost a small fortune to register everything.
I'm half-half on this.

I personally would rather have a system where every work is automatically put under Creative Commons (Attribution-Noncommercial-No Derivative Works). That way the artists can still make a profit, but normal people can share the work with out having to worry about being yelled at by artists.

That's freaking ridicious. People should just respect others work, whether it's copyrighted or not. The goverment shouldn't say "well, the artists didn't pay big bucks to get it copyrighted, so boo-hoo!"

Notice how there is no up-to-date information on this bill? I was scared that this "orphaned works" bill would become a reality, but then I saw this link in :iconidess:'s journal: [link]
